Terms of Service

By accessing or using cyberbeach.cc (the “Website”) and any services provided by CyberBeach (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Website or Services.

CyberBeach provides digital products and online services, including but not limited to: • Custom software development • Sale of digital goods (including accounts, access, or perks) • Proxy services (including residential, datacenter, or other proxy solutions) • Hosting services (including VPS, dedicated servers, or related infrastructure) • CAPTCHA solving services • Automation tools and API services • Website and application development We may operate under a limited “no questions asked” policy for certain services, except where legally required or where prohibited under these Terms.

You must be at least 18 years old and legally capable of entering into binding contracts to use our Services.

You agree not to use our Services or purchase our products for any activity that: • Violates any applicable local, national, or international law • Facilitates fraud, phishing, impersonation, or identity theft • Involves unauthorized access to accounts, systems, or data • Promotes violence, abuse, or terrorism • Infringes intellectual property rights • Distributes malware, ransomware, spyware, or harmful code • Violates privacy or data protection regulations • Uses proxies, hosting, CAPTCHA solving, or digital goods for illegal automation or abuse We reserve the right to refuse, suspend, or terminate Services at our sole discretion if misuse is suspected.

You agree that: • You are solely responsible for how you use any purchased product or Service • You will comply with all applicable laws and regulations • You will not misuse proxies, hosting, or CAPTCHA services • You understand that digital goods (accounts, perks, etc.) may carry inherent risks • You will not resell or redistribute services unless explicitly permitted CyberBeach assumes no liability for misuse of any product or Service.

• All digital goods are delivered “as is” • We do not guarantee longevity, stability, or continued access unless explicitly stated • Once delivered, responsibility transfers to the customer • Any modifications, bans, suspensions, or losses after delivery are not our responsibility

• Proxies are provided for lawful and ethical use only • Performance (speed, uptime, location) is not guaranteed unless specified • Abuse (spam, attacks, scraping restricted services, etc.) may result in immediate suspension without refund • We reserve the right to monitor usage for abuse prevention

• Customers are responsible for all content hosted on our infrastructure • Prohibited content includes illegal material, malware, phishing pages, or abusive services • We may suspend or terminate hosting without notice for violations • Backups are the customer’s responsibility unless explicitly included

• Provided strictly for lawful automation purposes • Use in bypassing security protections unlawfully is prohibited • Accuracy and success rates are not guaranteed • Abuse or excessive misuse may result in service restriction

• All prices are agreed upon before purchase or service activation • Payment must be completed before delivery unless otherwise stated • Failure to pay may result in suspension or termination • All fees are non-refundable except as stated below

11.1 Digital Goods & Services • All sales are final unless explicitly stated otherwise • No refunds after delivery of digital goods 11.2 Proxies, Hosting, CAPTCHA Services • No refunds once service access has been granted • Exceptions may be made at our sole discretion in cases of major service failure 11.3 Project-Based Work • Before work begins: 100% refund • After work starts: prorated refund • After delivery: no refunds unless agreed in writing 11.4 Non-Refundable Circumstances No refunds will be issued if: • You violate these Terms • Services are used for prohibited activities • You fail to communicate or provide required input for 30+ days

12.1 Client Ownership Upon full payment, ownership of custom-developed software is transferred unless otherwise agreed. 12.2 Company Rights We retain rights to: • General knowledge, frameworks, and reusable components • Display non-confidential work in our portfolio

We will maintain confidentiality of client-provided proprietary information. Clients may request a separate NDA if required.

All Services are provided “as is” and “as available.” We do not guarantee: • Continuous uptime or availability • Error-free operation • Compatibility with third-party systems • Financial or business outcomes

To the fullest extent permitted by law: • CyberBeach is not liable for indirect or consequential damages • Total liability is limited to the amount paid for the specific Service

You agree to indemnify and hold CyberBeach harmless from any claims arising from: • Your use of Services or products • Your violation of these Terms • Your violation of any law or third-party rights

We may suspend or terminate Services immediately if: • You violate these Terms • Payment is not made • We suspect abuse, fraud, or illegal activity

We reserve the right to modify Services, pricing, or Terms at any time.

These Terms shall be governed by and construed under the laws of Finland.

Disputes shall first be resolved through informal negotiation. If unresolved, disputes may be settled through: • Binding arbitration, or • Courts located in Finland

We may update these Terms at any time. Continued use of the Website constitutes acceptance of the revised Terms.
